These Terms & Conditions ("Terms") govern your use of the Couture By Ikigai website and services. By accessing or using our website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our website.

1. USE OF WEBSITE

You may use our website for lawful purposes only and in accordance with these Terms. You agree not to use our website:

  • In any way that violates any applicable federal, state, local, or international law or regulation
  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation
  • To impersonate or attempt to impersonate Couture By Ikigai, a Couture By Ikigai employee, another user, or any other person or entity
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the website, or which may harm Couture By Ikigai or users of the website

2. ACCOUNT REGISTRATION

To access certain features of our website, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

3. PRODUCTS AND PURCHASES

All products are subject to availability. We reserve the right to discontinue any product at any time.

Prices for our products are subject to change without notice. We reserve the right to correct any errors or omissions, and to change or update information at any time without prior notice.

By placing an order, you represent that the products ordered will be used only in a lawful manner. We reserve the right to refuse or cancel your order if we suspect you are under the age of 18 or that you may be using our products for illegal purposes.

Shipping and delivery timelines are estimates and may be affected by factors beyond our control, including carrier delays, customs inspections, weather, or other logistical disruptions. We are not responsible for such delays. If a delay occurs, we will make reasonable efforts to assist and, where available, request or facilitate shipping-cost refunds or credits from the carrier. Any refund related to delays, if approved, will be limited to shipping charges and will not include the cost of products or any other consequential losses.

4. INTELLECTUAL PROPERTY

The website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by CoutureByIkigai, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without our prior written consent.

5. LIMITATION OF LIABILITY

IN NO EVENT WILL COUTUREBYIKIGAI, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE WEBSITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

6. PERSONALIZATION TERMS OF USE

The following Terms of Use govern personalization orders placed with Couture by Ikigai. These terms are communicated to customers in writing at the time of their personalization request and must be acknowledged before production begins.

6.1 Approved Personalization Only

Personalization is limited to first names, class years, organization names, event names, approved spirit phrases, and family affiliation phrases. Requests outside these categories will not be accepted.

6.2 Prohibited Content

The following are strictly prohibited: full names of current or former coaches; names or jersey numbers of current student-athletes; any phrase referencing a specific named individual associated with a university athletics program; profanity, hate speech, or discriminatory language; and any content that violates applicable law or university brand guidelines.

6.3 Review and Approval

All personalization requests are subject to review and approval by Couture by Ikigai before design or production begins. Couture by Ikigai reserves the right to decline any request that does not meet these terms or university brand standards.

6.4 Licensed Mark Usage

Personalized products incorporating officially licensed university marks are subject to university design approval before production. Licensed marks may only appear on designs that have received institutional clearance.

6.5 Customer Responsibility

By submitting a personalization request, the customer confirms that their request complies with these terms. Customers are responsible for the accuracy of all personalization details submitted. Couture by Ikigai is not liable for errors resulting from incorrect information provided by the customer.

6.6 No Returns on Personalized Items

Due to the custom nature of personalized products, returns and exchanges are not accepted unless the product is defective or was produced incorrectly relative to the approved design. Defective personalized products will be fully reimbursed.

7. SMS MESSAGING TERMS

BY IKIGAI LLC (operating as Couture by Ikigai) offers SMS messaging services to provide you with order updates, alerts, promotional offers, and other notifications. By opting in to receive SMS messages, you agree to the following terms:

7.1 Types of Messages

You may receive the following types of SMS messages from BY IKIGAI LLC:

  • Transactional Messages: Order confirmations, shipping updates, delivery notifications, and customer service communications
  • Promotional Messages: Marketing offers, new product announcements, exclusive deals, and promotional campaigns
  • Alerts: Restock notifications, limited edition drops, and time-sensitive announcements

7.2 Message Frequency

Message frequency may vary depending on your activity and the types of messages you've opted into. You may receive up to 4-6 messages per month for promotional content, and additional transactional messages as needed for order updates.

7.3 Message & Data Rates

Message and data rates may apply for any messages sent to you from us and to us from you. The number of messages you receive will depend on the number of requests you make. Check with your mobile carrier for details about your messaging plan and any applicable charges.

7.4 Opt-Out Instructions

You may opt out of receiving SMS messages at any time by replying STOP to any text message you receive from us. After you send the message "STOP" to us, we will send you a confirmation message that you have been unsubscribed. You will no longer receive messages from us unless you re-opt in.

7.5 Help and Support

7.6 Carrier Liability

Carriers are not liable for delayed or undelivered messages. We are not responsible for any delays in the receipt of any SMS messages, as delivery is subject to effective transmission from your network operator. SMS message services are provided on an "as is" basis.

7.7 Privacy

We respect your privacy. Your phone number and any information you provide will be used in accordance with our Privacy Policy. We will not share your phone number with third parties for their marketing purposes without your explicit consent, except as necessary to provide the SMS service (e.g., with our SMS service provider).

7.8 Consent

By opting in to SMS messages, you consent to receive automated marketing and transactional text messages from BY IKIGAI LLC at the phone number you provided. Consent is not a condition of purchase. You may opt out at any time by following the instructions in Section 7.4.

7.9 Age Requirement

You must be at least 18 years of age to opt in to receive SMS messages from BY IKIGAI LLC. By opting in, you confirm that you meet this age requirement.

8. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Couture By Ikigai, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the website.

9. GOVERNING LAW

These Terms and any dispute or claim arising out of or related to them, their subject matter, or their formation shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice or conflict of law provision or rule.

10. CHANGES TO TERMS

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them. Your continued use of the website following the posting of revised Terms means that you accept and agree to the changes.
